Rider Waiver & Release of Liability
Please read carefully. All riders must agree to this waiver before departure.
You can review the waiver here ahead of time. When you book online you'll acknowledge this waiver; a signature is collected at check-in on tour day.
1. The Activity
Trikes & Tings VI ("the Company") operates professionally guided three-wheel trike tours in St. Thomas, U.S. Virgin Islands. Each trike is operated by a single rider. Passengers are not permitted. This is a guided tour; the Company does not offer rentals or self-guided tours.
2. Rider Eligibility
I confirm that I: am 21 years of age or older; hold a valid driver's license; am physically able to operate a three-wheel trike; and am not under the influence of alcohol, drugs, or any impairing substance.
3. Assumption of Risk
I understand that operating a motorized three-wheel trike on public and mountain roads involves inherent and unavoidable risks, including but not limited to loss of control, collision, mechanical issues, road and weather conditions, actions of other drivers, and serious injury. I knowingly and voluntarily assume all such risks, whether or not described here.
4. Safety Rules
I agree to wear the provided DOT-approved helmet at all times while riding, to complete the safety orientation, to follow all instructions given by my guide, to obey all traffic laws, and to ride at a safe and reasonable speed within the guided group at all times.
5. Security Deposit & Equipment
I understand that a $500 refundable security deposit and a credit card authorization are required and remain on file during the tour. The authorization may be used only for damage to equipment beyond normal wear and tear. The deposit is refunded after the tour once the trike has been inspected. I agree to be responsible for damage I cause to the trike or equipment through misuse or failure to follow instructions.
6. Release of Liability
To the fullest extent permitted by law, I release, waive, and hold harmless Trikes & Tings VI, its owners, guides, and employees from any and all claims, liabilities, or damages arising out of my participation, except for those caused by the gross negligence or willful misconduct of the Company.
7. Media Consent
I grant the Company permission to use photos or video taken during the tour for promotional purposes, unless I notify a guide otherwise in writing before the tour.
8. Acknowledgment
I have read and understood this Rider Waiver & Release of Liability, and I agree to its terms freely and voluntarily.
